What to do if you have been injured in an accident?
Have you been injured in an accident that was caused by the negligence of another party? Do you know what to do to secure your rights and obtain fair compensation for your injuries? - Take photographs of the damage to all vehicles involved in a motor vehicle accident, the accident scene and the other drivers. You can use your cell phone camera or a disposable camera that is kept in your glove box. A witness or passenger can take the photographs. If you are unable to take photos at the scene, do so as soon as possible.
- If you have been injured on someone else's premises, take photographs as soon as you can. Include objects or dangerous conditions that may have contributed to your fall or injury.
- Do you suspect the other driver might be intoxicated or under the influence of drugs or alcohol? Call the police, report your accident and report your suspicions. If the cars must be moved before the police arrive, it is important to photograph the position of the cars before they are moved.
- The sooner you document your injuries with a doctor or at a hospital emergency room, the better. If possible, get medical attention the same day, even if you do not feel any major pain or discomfort. Make certain to take correct precautions.
- Make note of the following: What happened to your body upon impact? Did you or any part of your body hit anything in the car? What position was your body in at the time of the impact? Was the impact unexpected? What did you see or hear just prior to impact? What symptoms, if any, did you experience at the scene of the accident? What symptoms did you experience by the end of the day and within 24 hours?
- Be honest and to the point in your communications at the accident scene. Whatever you say to the other driver, the investigating police officer, your passengers or witnesses is potentially admissible.
- Note any statements made by the other driver regarding what happened, particularly if the driver admits fault.
- Obtain names and contact information from witnesses.
- Be sure to report the accident to your insurance company and to the at-fault person's insurance company. However, check with an attorney before giving a statement to the other party's insurance company. If you give a statement, request a copy of it.
